Full payment for cards, services, postage and handling must be prepaid on all orders. No refunds will be given once your order is submitted. Wowcards reserves the right to apply the Customer‘s payment against any outstanding balances. Wowcards reserves the right to suspend service or to terminate this order in the event full payment is not made.
You may renew this agreement by submitting to Wowcards a new order. Any subsequent orders operate under the terms of this agreement unless such terms are modified and approved in writing by an authorized representative of Wowcards.
Online proofs are provided for free and are no guarantee of color accuracy.
Quoted turnaround is estimated and based on orders less than 500,000 cards and subject to change at any time without notice. Best efforts will be made to meet the target mail date specified by you on this web order form. Breakdown of equipment, hurricane damage, customer changes, or other circumstances may delay the mail date. Any delays or errors by you in providing art file(s) or mailing list(s) according to our specifications may result in a delayed mail date.
All of the graphic elements created by Wowcards, including designs, layouts, copy formats, and art, in producing your cards, are the property of Wowcards. These properties will NOT be sold or given to any other party. We reserve the right to provide samples to the USPS. We reserve the right to distribute free samples of your cards. Images of the cards we produce for you may be used in our marketing efforts and/or promotions.
You represent and warrant that you are the rightful owner of or have the legal right to reproduce any artwork, images, logos, brands names, trademarks, service marks, or any other content that appears on the cards you have ordered from Wowcards. You agree to defend, indemnify and hold Wowcards harmless from any costs, damages, liability and expense (including legal fees) arising from any third party claim to the contrary.
Our liability is limited to printing the cards you order & completing delivery to the U.S. Postal Service. Wowcards shall not be liable for USPS performance failures or delivery delays. Customer‘s mailing list(s), while in the possession of Wowcards is the exclusive property of the customer and shall be used only for customer‘s mailings. Customer‘s mailing list(s) will not be sold or offered for use to any other party, and Wowcards will not utilize the list for any other purpose. In no case is Wowcards liable for loss of business or implied damages.
This agreement will be construed in accordance with and governed by the laws of the State of Florida, without giving effect to the conflict of law principles of any other State or jurisdiction. Any controversy, claim or dispute arising out of or relating to this agreement, shall be settled by binding arbitration in Florida. Such arbitration shall be conducted in accordance with the then prevailing commercial arbitration rules of the American Arbitration Association. The parties agree to abide by all decisions and awards rendered in such proceedings. Such decisions and awards rendered by the arbitrator shall be final and conclusive and may be entered in any court having jurisdiction thereof as a basis of judgment and of the issuance of execution for its collection. All such controversies, claims or disputes shall be settled in this manner in lieu of any action at law or equity, provided however, that nothing in this paragraph shall be construed as precluding bringing an action for injunctive relief or other equitable relief. The arbitrator shall not have the right to award punitive damages or speculative damages to either party and shall not have the power to amend this agreement.
In the event that any provision of this agreement is held to be unenforceable under applicable law, this agreement will continue in full force and effect without such provision and will be enforceable in accordance with its terms.
This agreement embodies the entire agreement and understanding between the parties hereto with respect to the subject matter of this agreement and supersedes all prior or contemporaneous agreements and understandings other than this agreement relating to the subject matter hereof.
Checking the terms and conditions acceptance check box is an acknowledgment that you are an authorized representative for the company, person or entity placing the order and as such you agree to the terms and conditions presented herein and within this website.
